Agreement to Terms

By accessing or using OnlyBroken ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform.

Description of Service

OnlyBroken is a consumer advocacy platform that allows users to:

• Report issues with products, services, and companies
• Upload evidence supporting their reports
• Vote on and discuss issues reported by others
• Track the status and resolution of reported issues
• Connect related issues to show systemic problems

The Platform is provided "as is" and "as available" for your use.

User Accounts

To use certain features of the Platform, you must create an account using one of our supported authentication providers (Google, GitHub, or Apple).

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the Platform.

User Content

"User Content" refers to any content you submit, post, or display on the Platform, including issue reports, comments, evidence, and votes.

Content Standards

When submitting content, you agree that it:

• Is accurate and truthful to the best of your knowledge
• Does not contain false, misleading, or defamatory statements
• Does not infringe on any third party's rights
• Does not contain malware, spam, or harmful content
• Does not harass, threaten, or abuse others
• Complies with all applicable laws and regulations

Content Ownership

You retain ownership of your User Content. By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and improving the Platform.

Prohibited Activities

You agree NOT to:

• Submit false or fraudulent issue reports
• Impersonate any person or entity
• Manipulate votes, comments, or ImpactScores
• Use automated systems (bots) to access the Platform without permission
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the Platform or servers
• Harvest or collect user information without consent
• Use the Platform for any illegal purpose
• Post content that promotes discrimination, hatred, or violence
• Spam or flood the Platform with repetitive content

Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are owned by OnlyBroken and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, including "OnlyBroken," "ImpactScore," and "PowerLinks," may not be used without our prior written permission.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• The results from using the Platform will be accurate or reliable
• Any errors in the Platform will be corrected
• Companies will respond to or resolve issues reported on the Platform

OnlyBroken is not responsible for the actions or inactions of any company mentioned on the Platform. We provide a platform for consumer advocacy but cannot guarantee any specific outcomes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYBROKEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

In no event shall our total liability exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless OnlyBroken and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

Moderation and Termination

We reserve the right to:

• Remove or modify any User Content at our discretion
• Suspend or terminate your account for violations of these Terms
• Take any action we deem necessary to protect the Platform or users

If we terminate your account, you may lose access to all User Content associated with your account.

Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

1. Informal Resolution: Contact us first to try to resolve the dispute informally.
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Platform or sending an email.

Continued use of the Platform after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
